Terms and Conditions

  1. Contractual Relationship

Adventure Lockers utilises the Yellowbox digital locking system and User-app within each of it’s locker locations. Yellowbox provides a technology platform that enables users of its mobile applications and websites (‘Applications’) to access and use Yellowbox’s storage facilities (‘Services’). 

By accessing or using any of the Applications or Services, you acknowledge that you have read, understood and accepted the following terms and conditions and agree to be bound by them. This agreement creates a contractual relationship between you, Adventure Lockers and Yellowbox, and entitles you to use the Applications and Services. If you do not agree to the following terms and conditions, you are not entitled to use access or use any of these Applications or Services. 

In agreement with the Terms & Conditions set by Yellowbox, Adventure Lockers enables Yellowbox the right to expressly terminate these terms or any services and may deny the services or any portion, immediately, in the case where Yellowbox (and/or Adventure Lockers) reasonably suspects you have, or are likely to breach these Terms and Conditions. Yellowbox may also expressly terminate these terms or any services and may deny the services or any portion, on 30 days’ written notice to you, in the case where Yellowbox terminates these Terms and Conditions or any Services for any reasonable business, legal or regulatory reason. 

Yellowbox and Adventure Lockers reserve the rights to amend the following terms and conditions or any other policies related to the Service at any time. If Yellowbox or Adventure Lockers make a material change to the terms and conditions or any other policies, Yellowbox and Adventure Lockers will provide appropriate notice under the circumstances. Amendments to these terms will be effective when proper notice has been provided. Continued access or use of the Applications and Services after an amendment notice has been provided will constitute as acknowledgement, understanding and acceptable of the amendments. 

The acceptance of the user terms shall be deemed to include the acceptance of the privacy policy (which is available online). 

 

  1. The Services

The Services constitute a technology platform that enables users of Yellowbox’s mobile applications or websites provided as part of the Services (each, an “Application”) to provide storage services. 

Restrictions to service 

Items prohibited by law or considered hazardous under Australian legislation, as well as items which by their nature or packaging may cause harm to humans, to the environment or to other luggage carried and/or stored, are not allowed for storage. Yellowbox and Adventure Lockers do not permit the storage of, nor provide different services for goods which at our sole discretion are considered as hazardous or dangerous. Failure to abide by these terms may result in the termination of service. 

  

Yellowbox and Adventure Lockers do not permit the storage of prohibited items, including, but not limited to: plants and animals, alive or dead; material that can be considered as pornographic or indecent; weapons (firearms and bladed weapons); software containing information of high value; garbage; political material; hazardous materials; narcotic or psychotropic drugs; and other perishable goods. 

Third Party Services 

The services provided by Yellowbox and Adventure Lockers are to be made available or accessed with other third-party services that Yellowbox and Adventure Lockers do not control. The consumer also acknowledges that varying terms of use and privacy policies may apply to the uses of such third-party services. Adventure Lockers (and Yellowbox) does not endorse these services and in no extent will be responsible or liable for the services that these parties provide. These third parties are not parties to this contract and are not responsible for the provision or support of the service. The access to the services is set out in the third-parties' own terms of service. 

 

Use of Services 

In order to use most aspects of the Services, you must register for and uphold an active personal user Services account. Registration of an account requires a submission of personal information, such as your name, mobile phone number and email, as well as at least one valid payment method (either a credit card or accepted payment partner) to Yellowbox. You agree to uphold accurate, complete, and up-to-date information within your Account. Your failure to uphold accurate, complete, and up-to-date Account information, including having an invalid or expired payment method on file, may result in your inability to access or use the Services. You incur all responsibility for all actions and activity that occurs on your Account, and you agree to ensure the security and confidentiality of your Account username and password at all times. You may only possess one Account, unless stated otherwise as permitted by Yellowbox in writing. 

 

Network Access 

You are responsible for obtaining the data network access necessary to use the Services offered by Adventure Lockers via the Yellowbox App. Your mobile network’s data and messaging rates and fees may apply if you access or use the Adventure Lockers Services and Yellowbox App from a wireless-enabled device and you shall be responsible for such rates and fees. Adventure Lockers and Yellowbox do not guarantee that the Services will function on any specific devices. The Services and Yellowbox App required to access Adventure Lockers Locker units may be subject to malfunctions and delays inherent in the use of the Internet. 

 

Ownership of Property 

The Adventure Lockers applications and storage facilities are not sold or transferred to you, and Adventure Lockers retains ownership of all applications and storage facilities even after installation and use. 

 

  1. Payment

The use of the services may result in charges for the services that have been provided by Yellowbox and Adventure Lockers. Directly following these services, Adventure Lockers will will facilitate the payment of the relevant charges which will be processed through the Yellowbox user-app. These charges are due immediately and payment will be facilitated using the preferred payment method established in the Account, in which the receipt will be delivered to the customer by email. If the primary payment method is unable to be charged, you agree that Yellowbox (and Adventure Lockers) may use an alternative payment method in the account if available. 

Based on the contractual relation between the consumer, Adventure Lockers & Yellowbox, Adventure Lockers & Yellowbox reserve the right to establish, remove and/or revise charges for any or all services or goods obtained through the use of the services based on Adventure Lockers and Yellowbox’s sole discretion. 

The consumer may be responsible for the cost of repair for damage to, or necessary cleaning of Adventure Lockers / Yellowbox’s property as a direct result of usage of services under the account in excess of normal ‘wear and tear’ damages and required cleaning. In the event that such a need for repair and cleaning is required, Adventure Lockers & Yellowbox reserve the right to facilitate payment for the reasonable cost through the designated payment method. 

  

  1. Disclaimers

While Adventure Lockers takes great care to ensure lockers are completely safe and secure, we are unable to guarantee or insure against break-ins or destructive vandalism. Adventure Lockers, Yellowbox and the location partner are not liable for any loss or damage to property that is stored within the lockers during or after the provision of services. Adventure Lockers, Yellowbox and the location partner are also not liable in relation to any proven damages that can be considered as a direct or indirect consequence of the damage or loss of property that occurs from the service provided. In the event of a locker malfunction, Yellowbox, Adventure Lockers and the location partner will not be liable for any direct or indirect losses to the customer or related parties. 

It is the customer’s responsibility to ensure that all personal items are removed following the end of the service. The customer must keep the inside of the locker clean and clear of rubbish. Adventure Lockers, Yellowbox and the location partner are not liable for indirect, incidental, special, exemplary, punitive or consequential damages as a result from the use of the services that are provided. Adventure Lockers, Yellowbox and the location partner are not liable for any damages, liability or losses arising out of the use of or reliance on the services or inability to access these services provided. Adventure Lockers, Yellowbox or the location partner may not be liable for delay or failure in performance resulting from causes beyond Adventure Lockers or Yellowbox’s reasonable control. 

Adventure Lockers, Yellowbox, staff of the locker location, relevant security and local or federal patrolling agencies of the locker location reserves the right to inspect, maintain and reallocate the locker. This includes security checks, physical inspections and/or explosive trace detection of items stored within the lockers. 

 

Important Notes: • All dimensions are in mm. • All dimensions are +- 3mm and subject to change without notice. • All products and are manufactured and assembled in Australia. • Pricing is based on ALL goods being ordered and delivered / collected at one time unless otherwise specified in writing. • Please confirm that all details provided in quotes/invoices are accurate prior to ordering as no responsiblity will be accepted if you do not identify and correct any errors. • Lead times are ex-factory and are correct at the time of quoting. Lead times are subject to change when placing your order. Delivery Terms: • All deliveries are priced as ground floor or goods lift access only. • Does not include inductions, stair access, specific time requests, restricted time access or installation unless specified. • Based on immediate loading dock / zone access. • Delivery to occur within standard business hours (9am 5pm). Customer to advise if there are any height restrictions (for truck and goods) on site. All variations POA. • Military and mining sites may incur additional fees. If this is applicable to your quote, ensure it is noted else it will be added to your invoice. • Regional locations are delivered with the next available load going to the area. In some cases this may be 2-3 weeks after the goods are ready.
